User Agreement and Privacy Policy
KAWA ELECTRONICS COMPANY LIMITED (“KAWA”) hereby specially reminds user to carefully read and fully understand this User Agreement and Privacy Policy (“Agreement”). User shall carefully read and fully understand the terms and conditions of the Agreement, especially those involving the exemption or limitation of KAWA’s liability, the settlement of disputes and the governing law. The terms and conditions involving the aforesaid exemption or limitation will be shown in bold, to which you shall pay special attention during reading. Please carefully read and choose to accept or reject the Agreement (If you are a juvenile, please read it accompanied by your statutory guardian). Your acts such as downloading, installation and use of the Software, account acquisition and login will be deemed that you have accepted the Agreement and agree to be restrained by the terms and conditions hereof.
KAWA may modify the Agreement, and the modified version will be pushed to user in the form of pop-up window; user can view and choose whether or not to accept the content of the updated Agreement. Terms and conditions of the updated Agreement will be also released in the Software (launch the App > My > Settings > User Privacy Agreement) and will take effect from the date of release. If you reject any terms and conditions of the Agreement after modification by KAWA, you shall stop using the “KAWA” Software and Services provided by KAWA; your continued use of such Software and Services will be deemed as your acceptance of the modified Agreement.
I. General Provisions
1.1. This Agreement is entered into by and between you (or “user”) and KAWA in relation to your downloading, installation and use of the “KAWA” Software (“Software”) and use of relevant KAWA services.
1.2. The Software and Services refer to software and services provided by KAWA and installed on devices including but not limited to mobile terminal devices, providing user of the Smart Car DVR with connection and operation functions, as well as other KAWA services provided to user.
1.3. KAWA owns and has the power to operate the Software and Services.
II. Scope of Software License
2.1. KAWA grants user an individual, non-assignable, non-sublicensable and non-exclusive license to use the Software.
2.2. User may install, use, display and run the Software on mobile terminal devices for non-commercial purposes. However, user shall not install, use or run the Software for the purpose of commercial operation, or copy, change, modify, hook up or create any derivatives of, any data released to any terminal devices by or during running of the Software and any data of interaction between the client and the server during running of the Software, in any form including but not limited to use of any plug-in, add-on or unauthorized third-party tool/service for connection to the Software and relevant system. If commercial sales, reproduction or distribution is needed, such as software pre-installation and bundling, KAWA’s written authorization and permission must be obtained.
2.3. Without KAWA’s permission, user shall not install the Software on any other terminal devices not expressly accepted by KAWA, including but not limited to STB, game console, TV and DVD player.
2.4. User may make a copy of the Software for the purpose of using the Software and Services, which shall be used as backup only. Such copy must contain all copyright information contained in the original software.
2.5. Except those expressly granted hereunder, KAWA does not grant any other rights to user; to use such other rights, user shall otherwise get KAWA’s written consent.
III. Acquisition, Installation and Upgrade of Software
3.1. User shall download and install the Software in the way specified by KAWA. Do not download the Software in a way that is not specified to protect mobile terminal devices from being infected with malicious programs that can damage user data and obtain user’s privacy information. If user acquires the Software or the setup program with the name identical to the Software from a third party not authorized by KAWA, KAWA cannot guarantee that the Software will be used normally, and will assume no liability for any losses arising therefrom.
3.2. User must choose the Software version matching the Smart Car DVR installed; otherwise, user shall be responsible for any software problem, device problem or damage caused by incompatibility between the Software and the device model.
3.3. In order to improve user experience and service content, KAWA reserves the right to provide you with the substitute, modified or upgraded version of the Software from time to time, and may also charge you for such substitution, modification or upgrade with your prior consent. The Software enables the “Upgrade Prompt” function for user by default, depending on the Software version used. After release of a new Software version, KAWA will not guarantee the usability of the old version.
IV. Specification for Use
4.1. User may use the Software and Services in accordance with the Agreement on the premise of abiding by the law and the Agreement. User may not perform the following actions:
4.1.1. Delete any version information in the Software or other duplicates, or modify, delete or evade any technical measures of the Software set to protect intellectual property;
4.1.2. Reverse-engineer the Software, such as disassembly or decompilation of, or other attempts to obtain, source codes of the Software;
4.1.3. Add, delete or change the functions or operation effect of the Software by modifying or forging the instructions or data in the operation of the Software, or operate or disseminate the Software and methods used for the above purposes to the public, no matter whether these actions are for commercial purposes or not;
4.1.4. Use the Software for any acts that endanger network security, including but not limited to: use of unauthorized data or access to unauthorized servers/accounts; access to public networks or other operating systems or deletion, modification or addition of storage information without permission; unauthorized attempts to detect, scan or test the weaknesses of the system or network of the Software or other acts undermining network security; attempts to interfere with or destroy the normal operation of the Software system or website, intentional spreading of malicious programs or viruses and other acts sabotaging normal network information services; forging TCP/IP packet names or partial names;
4.1.5. User logs into or use the Software and Services, or make, publish or spread the above tools through any third-party compatible software or system not developed, authorized or accepted by KAWA;
4.1.6. User’s acts against the Software and the information contained therein without KAWA’s written consent, including but not limited to: using, leasing, lending, copying, modifying, linking, reprinting, assembling, issuing and publishing the Software and its information, building mirror image sites, developing derivatives, works, services, plug-ins, add-ons, compatibles or interconnections related to the Software by taking advantage of the Software without authorization;
4.1.7. Use the Software to publish, transmit, disseminate or store any content that violates national laws or jeopardizes national security, national reunification, social stability, public order or good customs, or any content that is inappropriate, insulting, defamatory, obscene or violent or that violates national laws, regulations or policies;
4.1.8. Use the Software to publish, transmit, disseminate and store any content that infringes other people’s legitimate rights such as intellectual property and trade secrets;
4.1.9. Use the Software to publish, transmit and disseminate advertising information and spam in bulk;
4.1.10. Use the Software and other services provided by KAWA in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the use licensed under the Agreement.
4.2. Specification for Information Release
4.2.1. If you use the Software to publish your original opinions or views, data, text, information, user name, pictures, photos, personal information, audio or video files, links and other information, you must guarantee that you own the intellectual property of the information you upload or have obtained legal authorization, and that your use of the Software and Services does not infringe the legitimate rights and interests of any third party. Meanwhile, you acknowledge and agree to authorize KAWA to safeguard, in KAWA’s name or by entrusting a professional third party, your rights against any infringement over the content with intellectual property you have uploaded or posted; forms of safeguarding include but are not limited to monitoring infringement acts, sending letters of right safeguarding, initiating legal proceedings or arbitration, mediation, reconciliation, etc.; KAWA has the right to make decisions on issues related to right safeguarding and to independently implement such decisions.
4.2.2. You know, understand and agree to grant, for the purpose of continuous improvement and provision of better services to you, KAWA (and its affiliates) and cooperators worldwide, royalty-free, non-exclusive, sublicensable (through multiple tiers) rights (including but not limited to the rights of reproduction, communication through information network, adaptation, compilation, alteration, translation, production of derivatives, performance, and display) over the content (including but not limited to text, pictures, images, audio files, video files and/or music, sound and dialogs in audio files) you upload, post, transmit or disseminate through the Software and Services; the scope of application includes but is not limited to the current or other websites, applications, products or terminal devices. You hereby acknowledge and agree that the granting of the above rights cover the right and permission of use in any publicity, promotion, advertising and/or marketing activities in relation to the content, the Software, KAWA and/or the KAWA brand, as well as the right and permission of developing content, in whole or in part, in other ways. To avoid confusion, you agree that the granting of the above rights covers the permission of using, reproducing, displaying and disseminating any personal image, portrait, name, trademark, service mark, brand, identification, company logo and other materials that you own or are licensed to use or that are placed in the content, as well as the right of commercial development.
4.2.3. You shall not use the Software to engage in the following acts, including but not limited to:
4.2.3.1. Creating, reproducing, publishing, disseminating and storing any content in violation of national laws and regulations:
(1) Violating the fundamental principles set forth in the Constitution;
(2) Jeopardizing national security, divulging state secrets, subverting the state power, or undermining the national unity;
(3) Damaging the reputation or interests of the state;
(4) Inciting ethnic hatred or discrimination to undermine ethnic solidarity;
(5) Detrimental to state religious policies, propagating heretical or superstitious ideas;
(6) Spreading rumors to disturb social order and jeopardize social stability;
(7) Disseminating obscenity, pornography, gambling, violence, murder and terror or crime-abetting;
(8) Humiliating or defaming others or infringing upon their legitimate rights and interests;
(9) Inciting illegal assemblies, associations, processions, demonstrations, gatherings to disrupt social order;
(10) Acting as an illegal civil society organization;
(11) Other contents as prohibited by laws and administrative regulations.
4.2.3.2. Publishing, transmitting, disseminating and storing any content that infringes upon the legitimate rights of others such as reputation right, portrait right, intellectual property right and trade secret;
4.2.3.3. Making up facts and concealing the truth to mislead and deceive others;
4.2.3.4. Publishing, transmitting and disseminating advertising information and spam;
4.2.3.5. Engaging in other acts in violation of laws, regulations, policies, public order and good customs, social morality, etc.
4.2.4. Without KAWA’s permission, you shall not use the Software in any commercial activities such as publishing advertisements and selling commodities.
4.3 You understand and agree that:
4.3.1. KAWA will determine whether or not you are involved in alleged violation of the above Specification for Use, and will suspend or terminate your license based the determination result or take other restrictions as agreed herein;
4.3.2. KAWA will directly delete information in alleged violation of laws, or in alleged infringement upon others’ legitimate rights, or in breach of the Agreement, posted by user when using the licensed Software.
4.3.3. If a third party suffers from damage due to your breach of the above Specification for Use, you shall bear the legal responsibility in your own name, and protect and indemnify KAWA from losses or additional expenses incurred therefrom.
4.3.4. If KAWA suffers from any losses, or is claimed by any third party or punished by any administrative authority due to your violation of applicable laws, regulations or the Agreement, you shall compensate KAWA for any losses and/or expenses incurred therefrom, including reasonable attorney fees and costs of investigation and evidence collection.
V. Privacy Policy and Personal Information Protection
5.1. It is very important to KAWA to protect your personal information. In order to provide software functions and improve user experience, KAWA will collect the following types of data:
Collection of Personal Information
5.1.1 Personal Information
We use, save and disclose your personal information in order to offer services to you by such means as account creation and user identification. KAWA will, with your permission, manage your personal photos and videos and provide relevant services and other materials, thus to offer you better services.
5.1.2 Collection for the Purpose of Service Realization
You can use the Software without a user account. If you want to use more functions of the Software, you need to provide relevant personal information. You must represent and warrant the following:
5.1.2.1 For the purpose of realizing the “KAWA” services, “KAWA” will collect your personal information (including such necessary information as your mobile phone ID, Smart Car DVR ID and use time) by technical means.
5.1.2.2 “KAWA” supports use of operating systems such as Android and IOS:
When you use “KAWA” via various mobile phone operating systems, the information collected by “KAWA” is only limited to that necessary for use of basic “KAWA” services with your permission.
5.1.2.3 Based on different business scenarios, “KAWA” is connected to a third-party SDK; we will use your personal information only for lawful, justifiable and necessary purposes, and will take strict security measures to protect your personal information;
a. In order to better maintain the stability of the “KAWA” app, “KAWA” uses “Google Firebase”, and this service requires collection of your log information and device information to better upgrade the app version.
5.1.3 Provision by User
5.1.3.1 If you need to use more “KAWA” functions such as Family Care and Vehicle Manage, the service will require storage of your birthday, anniversary, vehicle information and other information you set.
5.1.3.2 “KAWA” will use the commercially reasonable best efforts to keep confidential the information you provide. With your consent, “KAWA” will provide the version upgrade service to you.
5.1.4 Others Means of Service Provision
We will collect your personal information by other means (e.g., e-mail, information download, purchase of product or service, user support, feedback).
How Will Personal Information Be Used
Personal information is collected in order to provide you with products and/or services and to guarantee that we abide by applicable laws. You hereby consent to our processing of personal information for the purposes set forth in this Privacy Policy and to the disclosure of your personal information to us.
We may use your personal information for the following purposes:
Provide, process, maintain, improve and develop our products and/or services provided to you, including after-sales service, customer support as well as services provided via the device or website.
Communicate with you about your device, service or any general queries (e.g., updates, customer consultation support, information about our activities, notifications).
Create your KAWA account. The personal information collected when creating a KAWA account via the website or mobile device is used to create User’s personal account and data page.
Collect user feedback. The feedback you choose to provide is extremely valuable to help KAWA improve our service. In order to track the feedback you choose to provide, we may use your personal information to contact you and keep records.
VI. Service Risks and Disclaimer
6.1. User must prepare the equipment required for connecting mobile terminal devices to network and for use of value-added telecom services, and be responsible for the costs of networking or communication or information fees charged by third parties (including but not limited to telecom or mobile communication service providers). If value-added telecom services are involved, we suggest you to confirm relevant costs with your service provider.
6.2. KAWA and its cooperators will assume no liability for any losses incurred to user for any reason attributable to a third party such as communication line failure, technical problem, network, failure of mobile terminal device, system instability and other force majeure factors.
6.3. The Software, like most Internet software, may be affected by a number of factors, including but not limited to reasons attributable to user, network service quality, and social environment. It may also be affected by various security problems, including but not limited to other people’s use of user data, which results in harassment in real life. Other software downloaded or installed by user or other websites visited may contain “Trojans” or other viruses, threatening the security of user’s terminal device information and data, further affecting the normal use of the software. Therefore, user shall strengthen the awareness of protecting information security and user data, and pay attention to password protection, so as to avoid losses and harassment.
6.4. When user uses the Software or requires KAWA to provide a specific service, the Software may call a third-party system or use third-party software to support user’s use or access. The result of use or access will be provided by the third party. KAWA does not guarantee the security, accuracy, validity and other uncertain risks of the result realized with support from the third-party system or third-party software, and KAWA will not be liable for any disputes or damages arising therefrom.
6.5. KAWA specially reminds user that in order to guarantee the Company’s decision-making power in business development and adjustment, KAWA reserves the right to change or suspend services at any time without notifying user; KAWA will not be responsible to user or any third party for its exercise of the right to change or suspend services.
6.6. Unless otherwise expressly specified in laws and regulations, we will do our best to ensure the security, validity, accuracy and reliability of the Software and the technologies and information involved, but user shall understand that KAWA cannot guarantee the same due to restriction by the currently available technologies.
6.7. User shall be responsible for personnel injury or incidental or indirect economic damages (including but not limited to damages for profit loss, data loss and business interruption, or other commercial damages or losses) arising out of or in connection with any of the following situations: (1) use of or failure to use the licensed Software; (2) a third party’s unauthorized use of the Software or change of user data; (3) expenses and losses arising from user’s use of the Software; (4) user’s misunderstanding of the Software; (5) other losses related to the Software caused by reasons not attributable to KAWA.
6.8. For any personal injury or economic losses caused or likely to be caused by the fact that you are misguided or deceived during acts between you and other users of the Software through the Software, the party in fault shall take all responsibilities according to law.
VII. Intellectual Property Statement
7.1. KAWA is the owner of the intellectual property of the Software. All copyrights, trademarks, patents, trade secrets and other intellectual property of the Software, as well as all information content related to the Software (including but not limited to text, pictures, audio, video, charts, interface design, layout framework, relevant data or electronic documents) are protected by the laws and regulations of the People’s Republic of China and corresponding international treaties, and KAWA owns the above intellectual property rights.
7.2 Without the written consent of KAWA, user shall not implement, utilize or transfer the above intellectual property for any commercial or non-commercial purposes or license any third party to do so. KAWA reserves the right to investigate the legal liability for the above acts.
VIII. Change in Agreement
8.1. Where necessary, KAWA may modify the terms and conditions of the Agreement; once any modification is made, the terms and conditions after modification will be posted on relevant pages. If you do not consent to the changed content, you shall take the initiative to cancel the service. If you continue using the service, you will be deemed to have accepted such change.
8.2. KAWA and its cooperators may, as necessary, modify or change the paid services provided, the charging standard and method, the service fees and the service terms. It is possible that KAWA will charge user some fees for partial services it provides in the future. If user refuses to pay such fees, user shall not continue using relevant services after the start of charging, KAWA and its cooperators will use the best efforts to notify user of relevant modification or change by e-mail or other means.
IX. Governing Law and Dispute Settlement
9.1. The validity and interpretation of the terms and conditions hereof shall be governed by the laws in the mainland region of the People’s Republic of China. In the absence of applicable laws, international business practices and/or commercial practices shall be referred to.
9.2. Both user and KAWA agree that any dispute arising out of the Services shall be settled through negotiation between the two parties. Should such negotiation fail, either party may submit the dispute to a court with jurisdiction in the area where the Agreement is executed for settlement.
X. Miscellaneous
10.1. When you use a particular service of the Software, the service may have separate agreements, relevant business rules, etc. (collectively "individual agreements"). Please read and accept the relevant individual agreements before using the service.
10.2. The Agreement shall take effect on October 28, 2021. From this date, the Privacy Policy can provide details on how we manage the privacy of your personal information disclosed during your use of KAWA products and services, except specific KAWA products or services for which a separate privacy policy is provided.
10.3. The headings of all terms and conditions hereof are for convenience of reading only and have no actual meaning in themselves, which cannot be used as the basis for the interpretation of the meaning of this Agreement.
10.4. If any terms and conditions hereof become invalid or unenforceable for any reason, the remaining provisions hereof shall remain in force and be binding on both parties hereto.

Our Undertakings
This Privacy Policy specifies how KAWA and its affiliates (“KAWA” or “we”) collect, use, disclose, process and protect the information you provide to us when you use our products and services via our website www.kawa-in.com and the application suite we provide on the Smart Car DVR. If we ask you to provide some information in order to verify your identity when you use KAWA products and services, we will only use such information in strict accordance with this Privacy Policy and/or our user terms and conditions.
This Privacy Policy is developed with full consideration to your needs; it is crucial that you have a comprehensive understanding of our practices on collection and use of personal data and that you are convinced to maintain ultimate control over your personal information provided to us.
In this Privacy Policy, “personal information” refers to the data which can identify an individual after accessing the information itself or other information on the individual that KAWA can access. Such personal information includes without limitation your name, address, telephone number and e-mail address.
Your use of KAWA products and services represents that you have read, understood and accepted all terms and conditions set forth in this Privacy Policy, including any changes we may make at any time. We undertake to protect the privacy, confidentiality and security of your personal information in accordance with applicable laws (including the data protection law in your local area). At the same time, we undertake that all our employees and agents will fulfill these obligations.
Last, it is our hope to bring the best experience to our users. It will be our pleasure to directly handle your problems.
Log files: We collect specific information and save it in log files as most websites do. Such information may include Internet Protocol (IP) address, browser type, Internet service provider (ISP), reference/exit page, operating system, date/timestamp, and click-stream data. We will not link automatically collected data to other information which we collect about you.
Mobile analysis: In some mobile applications, we use mobile analysis software to better know the functions of our mobile software in your mobile phone. This Software can record such information as the frequency of your use of the application, events occurring in the application, cumulative use, performance data, and location where application crash occurs. We will not link information stored in the analysis software to any personal information you submit in the mobile application.
Who do we share your information with?
We will not sell any personal information to any third party.
Sometimes we may disclose your personal information to a third party (defined below) so as to provide you with the demanded products or services.
We may disclose your personal information to third-party service providers and affiliates listed in the following text of this section. Under circumstances mentioned in this section, you can be rest assured that KAWA will only share your personal information according to your authorization. You shall understand that in any situation described below, when KAWA shares your personal information with a third-party service provider, KAWA will specify the practices and obligations of the third party in a contract and comply with the applicable data protection law in your local area. KAWA will, by execution of a contract, guarantee that the third-party service supplier complies with the applicable privacy standard within the judicial district where you are located.
If required by applicable laws, KAWA may disclose your personal information without your further consent.
Information Not Requiring Consent
We may share anonymous information with third parties in an aggregated format for commercial purposes; we may share with them the general trend of use of our services, such as the number of customers among specific population purchasing certain products or engaging in certain transactions.
For the avoidance of doubt, KAWA may collect, use or disclose your personal information without your consent in situations expressly permitted by the local data protection law (for example, for the purpose of complying with summons); besides, we may disclose your information without your consent when we believe in good faith that such disclosure is necessary for protection of our rights, protection of your or others’ safety, investigation of fraudulent conducts or response to governmental requirements.
Security Guarantee
KAWA’s Security Measures
We undertake to guarantee your personal information security. In order to prevent unauthorized access, disclosure or other similar risks, we have implemented a reasonable process of physical, electronic and management measures to protect the information we collect from your mobile device and Car DVR. We will take all reasonable measures to protect your personal information.
We will take all feasible measures to protect your personal information. However, you shall be aware that the use of the Internet is not always secure, so we cannot guarantee the security or integrity of any personal information in a two-way transmission via the Internet.
What can you do?
You may not disclose your personal information to anyone (except for someone duly authorized by you).
KAWA will not be liable for any security breaches caused by a third party’s access to your personal information as a result of your failure to maintain the privacy of your personal information. Notwithstanding the foregoing, you shall notify us immediately of any unauthorized use of your account by other users of the Internet or any other security breaches.
Your assistance will help us protect the privacy of your personal information.
Retention Policy
If it is necessary to realize the purpose of information collection, or if it is required or permitted for compliance with applicable laws, we will retain personal information at all times. As long as it can be reasonably inferred that the purpose of personal information collection cannot be realized by retaining personal information, and it is unnecessary to retain personal information for the purposes of law abidance, dispute settlement and enforced implementation of our agreement or for other commercial purposes, we will no longer retain personal information, or we will eliminate any means of associating personal information with any individuals.
Specifically, KAWA will retain your personal information, such as any feedback you submit and your mobile phone number and e-mail address you provide when submitting the feedback, only for 3 months and only for the purpose of solving your problem, unless the time required for solving the problem exceeds 3 months. If you have any suggestions, please contact us as soon as possible by post or by e-mailing us at support@kawa-in.com.
Access to Other Functions on Your Device
Our applications may access some functions on your device, such as use of contacts for sending e-mails, storage of short messages, and Wi-Fi network state. Such information allows these applications to run on your device and also allows you to interact with them. You can revoke the license by closing the applications on your device or by contacting us at the e-mail address support@kawa-in.com.
You can control your information!
Control Setting
KAWA acknowledges that people’s concern about privacy varies. Therefore, we provide some examples to explain the different means provided by KAWA for your selection, thus to restrict the collection, use, disclosure or processing of your personal information and control your privacy setting:

If you previously have consented to our use of your personal information for the above purposes, you may contact us to change your decision at any time in writing or by e-mail at support@kawa-in.com.
Access to, Update or Correction of Your Personal Information
You may request access to and/or correction of any personal information we have about you. When you update your personal information, verification of your identity will be required before we process your request. Once we obtain information enough to process your request so as to access or correct your personal information, we will respond to your request within the time specified in the applicable data protection law.
Generally, we will provide these services free of charge, but we reserve the right to reasonably charge you for your data access request.
If you hope to access the personal data we hold, or if you believe that any information we hold about you is incorrect or incomplete, please contact us as soon as possible by post or by e-mailing us at support@kawa-in.com.
Transfer of Personal Information out of the Judicial District Where You Are Located
If we need to transfer your personal information out of the judicial district where you are located, we will comply with the applicable laws no matter whether such information is transferred to any of our affiliates or third-party service providers. Especially, we will implement proper security measures to guarantee that all such transfers meet the requirements of the local applicable data protection law.
Miscellaneous
Juveniles
We believe that it is the responsibility of parents to supervise their children’s use of our products and services. However, our policy does not require the acquisition of juveniles’ personal information or the sending of any promotion information to them.
KAWA will not seek or attempt to seek to receive any personal information from juveniles. If a parent or guardian reasonably believes that a juvenile has submitted his/her personal information to KAWA without prior consent of the parent or guardian, please contact us to ensure that such personal information is deleted and that the juvenile unsubscribes any applicable KAWA services.
Priority
If you have consented to the applicable User Agreement and there is any inconsistency between such User Agreement and this Privacy Policy, the former shall prevail.
Governing Law
This Privacy Policy shall be governed by the laws in the mainland region of the People’s Republic of China. We do not represent or warrant that the Privacy Policy complies with the privacy law in any judicial district; therefore, you shall not construe the Privacy Policy in accordance with such law.
Update of Privacy Policy
